Terms of service

Version 1.0.0 | 30 October 2026

Effective date: 30 October 2026.

About these terms

These terms apply to services supplied by SoFly Ltd, company number 12352152, of Newminster House, 27-29 Baldwin Street, Bristol, England, BS1 1LT.

They cover our websites, store, Accounts, desktop app, connected services, support and Social Club. Product-specific terms may add requirements explained before purchase or activation. They do not remove mandatory consumer rights.

Our Privacy Policy explains how we use personal information. Accepting these terms does not subscribe you to marketing or authorise optional tracking.

Eligibility and accounts

You must be at least 16 to register or use an account. If you are below the age at which you can enter a binding contract where you live, a parent or guardian must make or authorise the purchase as required by local law.

Provide accurate information, keep sign-in credentials secure and contact Support if you suspect unauthorised access.

You may use your account on your own devices without a numerical device limit. Accounts and licences are personal and must not be shared with other people.

Product licences

Purchasing a product gives you a personal, non-exclusive, non-transferable licence to use it for flight simulation and entertainment, subject to the applicable product description and terms.

You do not acquire ownership of the software, artwork, audio or other intellectual property.

Unless expressly permitted by the relevant licence or applicable law, you must not:

  • Sell, give away, sublicense or transfer a licence.
  • Share accounts, download links, activation credentials or product files.
  • Redistribute or commercially exploit the product.
  • Bypass access controls or reverse engineer protected software.

Products are for personal use. Commercial or organisational use requires separate written permission.

SoFly products are not intended for real-world flying, navigation, operational decisions or certified training.

Compatibility and connected features

Check the product description and system requirements before purchase. Compatibility is limited to the platforms and versions expressly stated.

Connecting an installation does not prove purchase or grant a licence. The Order Transfer service verifies eligible purchases made elsewhere; it does not transfer a licence between people.

Some features require an account, internet access or third-party services. We will explain material requirements before purchase. Nothing in these terms guarantees compatibility with every future simulator or third-party update.

We do not currently collect flight information. Future products using such information will provide additional terms and privacy information where needed.

Orders prices and taxes

The product and checkout pages explain the price, currency, contents and applicable requirements.

Applicable taxes are shown before purchase, with tax-inclusive prices displayed where required. The total payable is shown before you place the order.

An order is accepted when we confirm acceptance. If we cannot fulfil an order, we will explain the position and refund any payment taken for the unfulfilled purchase.

For purchases through another retailer, that retailer's purchase process and applicable refund obligations also apply. These terms do not reduce rights you have against the seller.

Withdrawal and refunds

Undownloaded digital products

You may request cancellation and a refund within 14 days of purchase if you have not downloaded the product. You do not need to give a reason.

You can request a refund through our refund tool or by opening a SoFly support ticket. Include enough information to identify your purchase and clearly state that you wish to cancel or request a refund. Staff manually review refund requests received through either route.

Where statutory withdrawal rights apply, use of the refund tool is not compulsory. You may also notify SoFly by any other legally valid clear statement, including by writing to our registered office. UK and EU consumers retain their applicable statutory withdrawal rights, including any longer period where required information was not provided.

Immediate downloads

If you expressly request supply during the statutory withdrawal period and acknowledge that you will lose the withdrawal right when supply begins, that right ends when supply begins, provided the applicable legal requirements have been met.

A digital-product acknowledgement by itself does not waive your rights.

Faulty or misdescribed products

Contact Support through a support ticket or use our refund tool if a product is faulty, not as described or otherwise fails to meet applicable legal standards. You may be entitled to repair, replacement, a price reduction or a refund, depending on the circumstances and applicable law.

Downloading a product does not remove these rights. They are not limited to 14 days.

Where a statutory cancellation refund is due, we make it within the applicable legal deadline, normally within 14 days of receiving your cancellation notice, using the original payment method unless otherwise agreed without additional cost.

Social Club

Social Club is free to join and provides email news, offers, invitations and relevant wishlist notifications.

Joining requires a clear request to receive those emails. Personalisation, email engagement tracking and advertising permissions remain separate optional choices.

You can unsubscribe at any time without deleting your SoFly account or losing purchased products. Social Club does not currently provide paid membership or a rewards programme.

Saving a product to a wishlist does not reserve it, guarantee a price or authorise every form of marketing.

Support and AI

OpenAI may process approved SoFly knowledge only. Customer messages and uploads are not sent to OpenAI. Staff review individual support enquiries and any assistance based on approved knowledge.

Ownership, access and refund decisions receive manual review. This includes refund requests submitted through support tickets.

Support guidance does not change the licence, product description or your statutory rights.

Your uploads

Only upload material you are entitled to share. Do not submit malware, fraudulent purchase evidence, unlawful material or unnecessary personal information about others.

You retain your rights in your uploads. You give SoFly and its service providers permission to store, copy and process them only as needed to provide the requested service, investigate the issue and meet applicable obligations.

Submitting support or purchase evidence does not give us permission to use it publicly in marketing.

Acceptable use and suspension

Do not use our services to commit fraud, infringe others' rights, compromise security, distribute malicious software or abuse other users or staff.

We may restrict access where reasonably necessary to address a breach, protect the service or comply with law. Where appropriate, we will explain the reason and how to request a review. Urgent security or legal circumstances may require immediate action.

Restrictions must be proportionate and do not remove statutory rights or automatically invalidate unrelated legitimate purchases.

Account deletion

You can request deletion through the available account controls or by contacting privacy@sofly.io.

Deletion permanently removes your SoFly account, product-library access and future downloads. Products and download access cannot be recovered or transferred to a replacement account after deletion.

Before confirming, save any files you are entitled to retain and understand that account-dependent features may stop working. Already downloaded products remain subject to their licences and technical requirements.

We retain necessary purchase and accounting/tax records for ten years from purchase, as explained in the Privacy Policy. Those records do not provide a library-restoration service.

Deletion is not a refund request and does not prevent you exercising mandatory consumer rights. We will not require account deletion to process a refund or privacy request.

Service changes and responsibility

We may maintain, update or change services for security, compatibility and operational reasons. Material changes affecting paid functionality will be handled in accordance with the contract and applicable consumer law.

We are responsible for foreseeable loss caused by our breach of these terms or failure to exercise reasonable care and skill.

We do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or consumer right that cannot lawfully be excluded.

Because products are supplied for personal use, we do not accept liability for business losses to the extent permitted by law.

Changes complaints and governing law

We will explain material changes to these terms and when they take effect. Changes do not retrospectively remove rights under existing purchases. Where agreement is required, we will obtain it.

Contact Support about service complaints. Privacy complaints can be sent to privacy@sofly.io.

These terms are governed by the law of England and Wales. Consumers retain mandatory protections and rights to bring proceedings in their home jurisdiction where applicable law provides them.
